Important: By using the Spaza Boost platform (including our WhatsApp bot, website, and related services), you agree to these Terms & Conditions. If you do not agree, please do not use our services.
1. About Spaza Boost
Spaza Boost is a digital marketing platform that connects township consumers with local spaza shop deals via WhatsApp. We operate in the Republic of South Africa and are subject to South African law.

2. Definitions
- "Platform" — The Spaza Boost website, WhatsApp bot, and all related digital services.
- "Consumer" — Any person who uses the Platform to find deals. Consumers use the service free of charge.
- "Shop Owner" — Any person or entity that registers a spaza shop on the Platform and pays a monthly subscription to post deals.
- "Deal" — A product special or promotion posted by a Shop Owner via the Platform.
- "Voucher" — A promotional code that grants free months of service.
3. Eligibility
You must be at least 18 years old and reside in the Republic of South Africa to use Spaza Boost as a Shop Owner. Consumers of any age may use the free deal-discovery service with the consent of a parent or guardian if under 18.
4. Service Description
4.1 For Consumers (Free)
- Search for deals near your location via WhatsApp.
- Browse deals by category (food, drinks, airtime, household, etc.).
- No registration required. No fees. Free forever.
4.2 For Shop Owners (Paid Subscription)

5. Registration & Account
- Shop Owners must provide accurate information during registration, including shop name, location, and a valid South African mobile number.
- You are responsible for all activity conducted through your WhatsApp number on our Platform.
- Spaza Boost reserves the right to verify your identity and reject or suspend registrations that appear fraudulent.
- One shop registration per WhatsApp number unless otherwise agreed.
6. Payments & Billing
6.1 Billing Cycle
Subscriptions are billed monthly from the date of registration. Your subscription renews automatically unless you cancel.
6.2 Payment Methods
- Card/EFT: Pay via debit/credit card or instant EFT through our secure payment partner, Paystack.
6.3 Failed Payments
If a payment fails (declined card), your account will be suspended and your deals will be hidden from consumers. You will receive a WhatsApp reminder to retry payment. After 7 days of non-payment, your shop listing may be deactivated.
6.4 Refunds
In accordance with the Consumer Protection Act (CPA), Section 14:
- You may cancel your subscription at any time by messaging "Cancel" to our WhatsApp bot.
- Cancellations take effect at the end of your current billing period — no pro-rata refunds for partial months.
- If you cancel within 5 business days of your first subscription and have not posted any deals, you may request a full refund.
6.5 Vouchers & Promotions
- Voucher codes provide free months of Standard or Premium service.
- Vouchers are single-use, non-transferable, and have an expiry date.
- Spaza Boost reserves the right to cancel or modify promotional offers at any time.
- After a voucher period expires, normal subscription billing applies automatically.
7. Acceptable Use Policy
Shop Owners agree NOT to post:
- False, misleading, or deceptive deals or pricing.
- Illegal, counterfeit, stolen, or prohibited goods (including unlicensed alcohol, tobacco to minors, drugs, or weapons).
- Content that is hateful, discriminatory, sexually explicit, or violent.
- Spam or repetitive deals designed to flood consumer feeds.
- Deals for goods you do not actually have in stock.
Violation Consequence: Spaza Boost may suspend or permanently ban any Shop Owner who violates this policy, without refund. Repeated violations will be reported to the relevant authorities.
8. Content Moderation
- All deals are subject to automated and/or manual review.
- Spaza Boost reserves the right to remove any deal that violates our Acceptable Use Policy or is reported by consumers.
- Shop Owners retain ownership of their product photos and descriptions but grant Spaza Boost a non-exclusive licence to display them on the Platform.
9. Data Protection (POPIA Compliance)
We process personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA). Please refer to our Privacy Policy for full details on:
- What data we collect and why.
- How we store, process, and share your information.
- Your rights as a data subject (access, correction, deletion).
- How to lodge a complaint with the Information Regulator.

10. Consumer Protection Act (CPA) Compliance
As a service provider under the CPA (Act 68 of 2008), Spaza Boost commits to:
- Transparency: Clear pricing, no hidden fees, all terms available in plain language.
- Right to Cancel: Shop Owners may cancel at any time (Section 14).
- Right to Fair Value: Our service descriptions accurately reflect what you receive.
- Right to Privacy: Your personal information is protected under POPIA (Section 11).
- No Unfair Terms: These terms are drafted to be fair to all parties (Section 48).
- Cooling-Off Period: 5 business days for direct marketing subscriptions (Section 16).
11. Intellectual Property
- The Spaza Boost name, logo, branding, and all Platform content are the intellectual property of Spaza Boost.
- You may not copy, reproduce, or redistribute any Spaza Boost intellectual property without written permission.
- Shop Owners retain ownership of their own product photos and deal descriptions.
12. Limitation of Liability
- Spaza Boost is a marketing platform only. We do not sell products, process deliveries, or guarantee the quality of any goods sold by Shop Owners.
- Consumers purchase goods directly from Shop Owners at the shop premises. All disputes about product quality are between the Consumer and the Shop Owner.
- Spaza Boost is not liable for any loss, damage, or injury arising from transactions between Consumers and Shop Owners.
- Our total liability to any user shall not exceed the amount paid to us in the 3 months preceding any claim.
13. Service Availability
- We aim for 99% uptime but do not guarantee uninterrupted service.
- The Platform relies on WhatsApp (Meta) and third-party payment providers. Outages by these providers are beyond our control.
- Scheduled maintenance will be communicated via WhatsApp broadcast where possible.
14. Dispute Resolution
- Step 1: Contact us at support@spazaboost.co.za. We will respond within 5 business days.
- Step 2: If unresolved, either party may refer the dispute to mediation.
- Step 3: If mediation fails, the dispute will be resolved by arbitration in accordance with the Arbitration Act, 1965.
- Governing Law: These terms are governed by the laws of the Republic of South Africa.
- Jurisdiction: The High Court of South Africa shall have jurisdiction over any legal proceedings.
15. Changes to These Terms
Spaza Boost may update these Terms from time to time. Material changes will be communicated via WhatsApp broadcast and posted on the website. Continued use of the Platform after changes constitutes acceptance.
